GENERAL TERMS & CONDITIONS OF UNCONVENTIONAL WARDROBE
Clause 1 | General
1.1 The General Terms and Conditions of Unconventional Wardrobe (hereafter referred to as the 'Conditions') apply to all offers, orders, agreements and deliveries made by or with Unconventional Wardrobe (UNC). By placing an order you agree to be bound by these Conditions. If you ask, a copy of these Conditions can be sent to you free of charge. It's also possible to consult these Conditions online via: http://uncwardrobe.com/pages/frontpage
1.2 It's only possible to deviate from these Conditions if agreed in writing. In this case all the other provisions remain in effect.
1.3 Only persons aged 18 years or older, who are not under guardianship are able to place an order.
1.4 Whether products or services are offered at uncwardrobe.com, does not warrant that these products or services are available at any time. We reserve the right to withdraw products.

Clause 2 | Agreement, Order and Delivery costs
2.1 The agreement becomes binding at the time that you place your order by clicking the 'Place order' button on the order form (the last form in the order process, with the item description and billing address). Once your order's been placed, UNC processes it by means of the order form on the website. You'll receive an email confirming your order at the email address you've given. Even if you don't receive an email, your order still remains in effect.
2.2 All prices quoted by UNC are in euros and include 21% VAT. UNC is entitled to adjust its prices. The adjustments apply from the time they're published on the website and don't apply to items that have already been ordered.
2.3 UNC charges no delivery costs for deliveries within the Netherlands. Delivery costs per European country vary, click here to see the rates per destination.
2.4 Prices on the website and in store may vary.
2.5 All prices on the website are subject to misprints. For the consequences of misprints no liability is accepted.
Clause 3 | Delivery
3.1 UNC is extremely careful with the registration and processing of orders and strives to deliver your order to your home address or collection point in the Netherlands, in accordance with your chosen delivery method.
3.2 When your order is to be delivered within the Netherlands, UNC does its best to send it within 24 hours of receipt of payment. The item will be delivered within 1 to 3 days after you ordered it. If this isn't possible (because, for example, your order is temporarily out of stock) or an order can only be met in part, then you'll be notified within 48 (forty-eight) hours of the order being placed. In this case you're entitled to cancel your order without having to pay anything.
3.3 UNC strives to ship your order within 24 hours after receiving the payment. Although we aim to deliver within the deadline, delays may result from unexpected events.
3.4 The delivery takes place subject to availability.
3.5 The place of delivery is the address that the consumer provided to UNC.
3.6 If you've given UNC the wrong delivery address, then you'll have to pay the extra delivery costs yourself.
3.7 You're obliged to take delivery of the purchased items at the time they're delivered to you.
3.8 All time limits mentioned on the website are indicative. From the mentioned terms are therefore not legally binding.
Clause 4 | Cancellation of an order
4.1 UNC does its best to ensure that its customers are happy with their purchases. If you're not satisfied with your purchase, you have 14 (fourteen) days from the date on which you receive the item to return it, without giving any reason, to:

4.2 You can dissolve the agreement or return the items. You need to inform UNC of this within 14 (fourteen) days via the return form that's included in your delivered package. You will need to fill in the return form and send this back to us with the items you have ordered.
4.3 If the customer after 14 days has not returned the delivered items to UNC, the purchase is a fact.
4.4 UNC guarantees a full refund or replacement if required (if available) of returned items pursuant to section 4 (cancel an order), provided that all items be returned in the same condition they were in when received. This implies that the articles are not damaged, dirty, washed, modified, or performed (other than the fit of the item) may be, and that labels or price tags have not been removed.
4.5 You will have to prove that the goods are returned on time, for example through a proof of postal delivery.
4.6 You yourself are responsible for the cost of returning the items. However, you have the opportunity to deliver your package free of charge at our store on the Oude Binnenweg 42 in Rotterdam.
4.7 If you return the entire order and you have already paid, you will receive the amount excluding shipping costs from UNC. Once the item has been received and checked, your money, less delivery and packaging costs, will be refunded within 14 (fourteen) days.
4.8 If a received item is defective, let UNC hereof know immediately and send back the article as set put in paragraph 4 (revoke an order). All products as defect notification, on the condition that this is done within seven days, are refunded by UNC. The provisions in these conditions do not restrict any legal rights.
Clause 5 | Shipment and Transport
5.1 UNC is responsible for damage, theft or loss which occurs during the shipment of the items. The risk passes to you at the time of delivery.
5.2 UNC sends packages via parcel post service or MYPARCEL.
Clause 6 | Payment and Payment Methods
6.1 At UNC you can choose between 3 (three) safe methods of payment: iDeal, Credit Card and Bancontact.
6.2 Payments using iDEAL are processed via Mollie secure procedure. Mollie is one of the most reliable Payment Service Providers in the Netherlands.
6.3 You can pay with credit card via the Credit card payment option. If you choose this payment option, then your payment will be processed via a secure Mollie connection.
6.4. Payments for Belgian customers can be processed via a secure Bancontact connection.
6.5 UNC retains full ownership of all the delivered items until such time as the purchase price and any other amounts due to UNC have been paid in full.
7. Clause 7 | Liability
7.1 Liability on the part of UNC for direct or indirect damage caused by an item purchased from it is in any case limited to an amount equal to the selling price of that item, unless and in so far as there has been malice or gross negligence on the part of UNC.
7.2 UNC is not responsible for indirect losses that are a side effect of the original loss of the original damage, such as loss of profits or loss of opportunity, or non-delivery of goods or failure to comply with any other obligation under these Conditions if such failure is due to events beyond our control, including but not limited to for example: fire, flood, storm, rebellion, political unrest, war, nuclear accidents and terrorist activities.
7.3 Our maximum liability to you for any loss or damage which may arise from your order on uncwardrobe.com is limited to the total amount of your order.
7.4 All images; photos, videos, etc. ; information on weights, colors, graphics, labels, etc. on the UNC website are only approximate and indicative and may not lead to damages or rescission of the contract.
Clause 8 | Force Majeure
8.1 For the purposes of this clause, force majeure means all shortcomings which cannot be attributed to UNC or cannot be restricted under legislation.
8.2 If UNC is unable to meet its obligations due to force majeure, those obligations will be suspended for the duration of the state of force majeure. After 30 (thirty) days both parties have the right to dissolve the agreement either in whole or in part by means of a written declaration, without being entitled to any damages or compensation.
Clause 9 | Guarantee
9.1 UNC guarantees that the items to be delivered by us meet the usual requirements and norms which can reasonably be expected at the time of delivery and that they are fit for the purposes for which items of the same type are normally used in the Netherlands. If the items are to be used outside the Netherlands, you need to check that the item is fit for use there.
9.2 You are required to check the delivered item at the time of its delivery, and certainly within the set 'cancel an order' period of 14 (fourteen) days. When doing this, you should make sure that the quality and quantity of what has been delivered corresponds with what was agreed, and at least meets the requirements which apply to it in normal trade. Should the delivered item(s) are incorrect or incomplete, you are required (before proceeding to return to UNC) to inform these defects immediately by e-mail to UNC. Any defects or faulty goods should and can be confirmed at the latest up to seven days after delivery at UNC by email.
9.3 If clothing is damaged after being worn, after discovery of failure, damage occurring after wearing, does expire the right to claim and return.
9.4 This warranty does not apply if: 1) as long as the purchaser against UNC is in default; 2) the customer has repaired the delivered goods themselves and / or processed by third parties to repair and / or editing; 3) the delivered goods have been exposed to abnormal conditions or otherwise carelessly handled or treated in violation of the instructions of UNC and / or instructions on the packaging.
9.5 Once the guarantee period referred to in Clause 4.1 has expired, UNC is entitled to charge all repair or replacement costs, including administrative, delivery and call out charges.
9.6 When purchasing articles in the uncwardrobe.com webshop, the guarantee law applies. Legal guarantee means that the product must do what the consumer can reasonably expect. There is no legal time limit on this guarantee because what the consumer expects, differs per product.
Clause 10 | Colors
10.1 We do everything reasonably possible to the features of our products, including the composition and display colors as accurately as possible.
10.2 The color you see will depend on your computer system, and UNC cannot guarantee that your computer will display colors correctly.
Clause 11 | Privacy & Data management
11.1 If you place an order at UNC, your data will be included in the customer base of UNC. In line with the Data Protection Act, your data will not be provided to third parties.
11.2 UNC respects the privacy of her website users and ensures confidentiality of your personal information.
11.3 UNC can use a mailing list if you subscribed. Each mailing includes instructions to remove yourself from this list.
Clause 12 | Copyright photos and images
12.1 All the photos and images which (will) appear on UNC are protected by copyright, regardless of the manner in which they're disseminated or the form in which they're delivered. It's not allowed to publish or copy the photos or images in any way whatsoever without written consent from UNC.
12.2 If you go ahead and use a photo or image anyway without prior written consent from UNC, you'll be summoned to desist and a claim for damages will also be lodged against you.
Clause 13 | Transfer
13.1 UNC reserves the right to any claims for payment (including any payment) to be transferred, in associated with the delivery of goods, to a third party.
Clause 14 | Severability
14.1 The any part(s) of these Conditions were to be invalid or canceled by a court or regulator, the remaining conditions remain effective.
Clause 15 | Disputes
15.1 All legal relationships to which UNC is a party are governed exclusively by laws of the Netherlands, even if an agreement is going to be executed in whole or in part abroad or if the other party to the legal relationship has a residence there.
15.2 Disputes arising from an agreement between UNC and client, which cannot be resolved by mutual agreement, the dispute must be brought before a competent court in the district of Rotterdam, unless UNC prefers to give the difference to the competent court or the place of residence of the purchaser subdue.

Article 1 | G eneral
1.1 These general terms and conditions apply to all orders placed by the customer (hereinafter referred to as “you”) with Unconventional Wardrobe BV (UNC), hereinafter referred to as “UNC”, “us” or “we”, via the UNC website, the mobile website or a mobile device (collectively referred to as “unconventionalwardrobe.com” or “uncwardrobe.com”).
1.2 By using uncwardrobe.com and/or placing an order, you accept to be bound by the terms and conditions set out below (the “Terms”). Please ensure you have read and understood the Terms before placing your order.
1.3 Only persons aged 18 or older who are not under guardianship can place an order.
1.4 The fact that products or services are offered on uncwardrobe.com at any time does not guarantee that these products or services are available at all times. We reserve the right to withdraw products at any time.
1.5 The version of the Terms that applies to your order is the version available on the UNC website at the time your order was placed.

Article 2 | Agreement, order and delivery costs
2.1 The prices stated on uncwardrobe.com are in Euros and include statutory VAT.
2.2 UNC does not charge delivery costs within the Netherlands.
2.3 All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors.
2.4 Prices in store and online may vary.
2.5 If you have registered your email address, you will receive a confirmation by email after placing an order. If we are unexpectedly unable to deliver your order, we will let you know as soon as possible. If the order has already been paid, we will try to refund the payment via the payment method you used. If the refund needs to be made in another way, UNC will contact you to arrange this.
2.6 An order must amount to at least € 1.00 (after deduction of discounts).
Article 3 | Delivery
3.1 UNC takes the utmost care when registering and processing orders and strives to deliver your order to a residential address or collection point in the Netherlands, in accordance with the delivery method you have chosen.
3.2 If UNC needs to deliver the order within the Netherlands, UNC strives to ship it within 24 hours of receipt of payment. The item will be delivered within 1 to 3 days after your payment is received by us. If this is not possible (because, for example, your order is temporarily out of stock) or an order can only be partially packed, you will be notified by UNC within 48 (forty-eight) hours of the order being placed . In this case you have the right to cancel your order without any additional costs.
3.3 UNC strives to ship your order within 24 hours after receipt of payment. Although we strive to deliver within the stated timeframe, delays may occur due to unexpected events.
3.4 Delivery takes place while stocks last.
3.5 The place of delivery is the address that the consumer has made known to the company.
3.6 If you have given UNC the wrong delivery address, you will pay the additional costs for delivery yourself.
3.7 You are obliged to accept the purchased products when they are made available to you.
3.8 All terms stated on the website are indicative. Therefore, no rights can be derived from the stated periods.
Article 4 | Returns
4.1 You have the right to return (part of) the delivered goods within a period of 14 (fourteen) days from the moment of delivery, without giving any reason, to:

4.2 You can cancel the agreement or return the items. You must inform UNC of this within 14 days, via the returns form that came with your package. Complete this returns form completely and send it to us with the items you ordered.
4.3 If the customer has not returned the delivered goods to UNC after this period (14 days), the purchase is a fact.
4.4 UNC guarantees a full refund, or replacement (if available), of returned items pursuant to paragraph 5 (Withdrawal of an Order), provided that all items are returned in the same condition as they were upon receipt. This means that the items must not be damaged, dirty, washed, altered or worn (other than trying on the item) and that labels or price tags have not been removed.
4.5 You must prove that the delivered goods have been returned on time, for example by means of proof of postal delivery.
4.6 If you exercise your right of withdrawal, the shipping costs for returns will not be reimbursed by UNC. You do have the option to deliver your package free of charge at The Fashion Boutique at Oude Binnenweg 42 in Rotterdam.
4.7 A 14-week reflection period also applies to jewelry.
4.8 If you return the entire order and have already paid for it, you will receive a refund excluding shipping costs. Provided we have received the items or proof that the items have been returned. Once your package has been received and checked, your money, minus delivery and packaging costs, will be refunded within 14 (fourteen) days.
4.9 If a received item is defective, please notify UNC immediately and return the item as set out in paragraph 4 (cancellation of an order). All products reported as defective, provided this is done within 7 days, will be reimbursed by UNC. The provisions of these terms and conditions do not limit any statutory rights.
Article 5 | Shipping & transportation
5.1 During the transport of the products, UNC will bear the risk in the event of damage, theft or loss of the products. The risk passes to you at the time of delivery.
5.2 UNC sends packages via the MYPARCEL parcel post service.
Article 6 | Payment methods
6.1 On the UNC website you can choose from 3 (three) secure payment methods: iDeal, Bancontact and Credit card.
6.2 Payment with IDEAL is made via a secure Mollie connection. Mollie is one of the most reliable platforms in the Netherlands.
6.3 You can pay with your Credit Card. Credit card payments also take place via a secure Mollie connection.
6.4. Belgian consumers can choose to make their payment via a secure connection from Bancontact (Mollie).
6.5 Unconventional Wardrobe remains the sole owner of all delivered products until the purchase price and any other amounts due have been paid in full.
Article 7 | Liability
7.1 UNC's liability for direct or indirect damage caused by an item purchased from it is in any case limited to an amount equal to the sales price of the item, unless there is intent or gross negligence on the part of UNC. Our maximum liability to you for any loss or damage arising from your order on uncwardrobe.com is limited to the total amount of your order.
7.2 UNC shall not be responsible for any indirect losses incidental to the original loss or damage, such as loss of profit or opportunity, or failure to deliver goods or to fulfill any other obligation hereunder Conditions, if such failure is due to events beyond our control including, but not limited to, fire, flood, storm, riot, political unrest, war, nuclear accident and terrorist activity.
7.3 Our maximum liability to you for any loss or damage arising from your order on uncwardrobe.com is limited to the total amount of your order.
7.4 All images; photos, videos etc.; data regarding weights, dimensions, colors, images of labels, etc. on the UNC website are only approximate, are indicative and cannot give rise to compensation or termination of the agreement.
Article 8 | Force majeur
8.1 In this article, force majeure is defined as: all shortcomings for which UNC cannot be blamed or cannot limit or exclude under the law.
8.2 In the event of force majeure as a result of which UNC cannot meet its obligations, the obligations will be suspended for the duration of the force majeure situation. After 30 (in words: thirty) days, both parties have the right to dissolve the agreement in whole or in part by means of a written statement, without the right to any (damage) compensation.
Article 9 | Guarantee
9.1 UNC guarantees that the products it supplies meet the requirements of usability, reliability and service life as reasonably intended by the parties to the purchase agreement. If the goods you purchase show defects, UNC will fully comply with the statutory warranty regulations.
9.2 You are obliged to check the delivered goods immediately upon receipt. If it appears that the delivered item is incorrect or incomplete, you must immediately report these defects to UNC by e-mail (before returning it to UNC). Any defects or incorrectly delivered goods must and can be reported to UNC by e-mail up to a maximum of 7 days after delivery.
9.3 Putting into use after discovery of a defect, damage occurring after discovery of a defect, encumbrance and/or resale after discovery of a defect, completely voids this right to complain and return.
9.4 This warranty does not apply if: 1) and as long as the customer is in default towards UNC; 2) the customer has repaired and/or processed the delivered goods himself or has had them repaired and/or processed by third parties; 3) the delivered goods have been exposed to abnormal conditions or have otherwise been treated carelessly or have been treated contrary to UNC's instructions and/or instructions for use on the packaging.
9.5 After the warranty period referred to in Article 4.1 has expired, UNC is entitled to charge all costs for repair or replacement, including administration, shipping and call-out costs.
Article 10 | To colour
10.1 We do everything reasonably possible to represent the properties of our products, including the composition and colors, as accurately as possible.
10.2 The color you see will depend on your computer system, and UNC cannot guarantee that your computer will display these colors correctly.
Article 11 | Privacy & Data Management
11.1 If you place an order with UNC, your information will be included in UNC's customer database. In line with the Personal Records Act, your data will not be provided to third parties.
11.2 UNC respects the privacy of the users of the website and ensures confidential treatment of your personal data.
11.3 If you have registered for this, UNC can use a mailing list. Each mailing contains instructions to remove yourself from this list.
Article 12 | Property rights
12.1 All intellectual property rights, such as trademarks and copyrights on uncwardrobe.com belong to Unconventional Wardrobe BV or licensors.
12.2 Any use of uncwardrobe.com or its content, including copying or storing such content in whole or in part, other than for your own personal and non-commercial use is prohibited without the prior written permission of UNC.
Article 13 | Handover
13.1 UNC reserves the right to transfer or transfer any claims for payment (including any payment terms) in connection with the delivery of goods to a third party.
Article 14 | Severability
14.1 If any part of these Terms is held to be invalid or void by any court or legislature, the remaining Terms will remain in effect.
Article 15 | Applicable law
15.1 All legal relationships to which UNC is a party are exclusively governed by Dutch law, even if an obligation is wholly or partially performed abroad or if the party involved in the legal relationship is domiciled there.
15.2 Disputes arising from an agreement between UNC and the buyer, which cannot be resolved by mutual agreement, will be dealt with by the competent court within the district of Rotterdam, unless UNC prefers to submit the difference to the competent court of the place of residence of the buyer. buyer, and with the exception of those disputes that fall within the jurisdiction of the subdistrict court judge.
